Condos, Communication, Noise and Tribunals
Courtesy of CBC News 2024-06-28 Tribunal decision reveals strata's struggle to find strange noise.
Note that this is based on British Columbia which has different terminology - strata instead of condos and councils instead of boards.
The article highlights the difficulty in diagnosing noise problems in condos and finding a suitable solution. Multiple fines were levied against the unit owner allegedly causing the noise even though they took steps to mitigate possible causes. Despite extensive efforts to determine the cause of the noise, no diagnosis was confirmed. The board didn't strictly follow the provincial condo act, didn't engage in adequate communication and fined the alleged offending unit owner multiple times with fines totally over $40,000. The case went to the provincial tribunal who found in favour of the alleged offender and against the board who then had to cancel the fines.
