What happens when a condo owner refuses access to his unit?

An article published by CondoBusiness, part of the REMI Network describes a court case in Ontario in which a unit owner refused access to their exclusive-use balcony to allow for maintenance and inspection of roof anchors not related to their own unit. In the end, the judge decided in favour of the condominium corporation because it was maintaining the property in a reasonable manner. 
The “reasonableness” test is also applicable in Manitoba. Section 90 of the Manitoba Condominium Act states that a condo corporation or its agent can enter a unit in emergency situations without consent or notice as long as notice requirements have been met.
The lesson learned from Ontario and applicable to condominium corporations in Manitoba is that both unit owners and the condominium corporation must be reasonable when access to a unit is required to carry out the business of the corporation.

CRA introduces new rule to deter property flipping

The federal government and the Canada Revenue Agency have introduced a new rule to deter real estate speculators. Basically, the rule says any gain on the sale of a condo unit that was purchased within the prior 12-month period wll be classified as income, as opposed to being eligible for the 50 per cent capital gains inclusion rate or the principal residence exemption.  Click here for details.
